Prior notification of waste businessman

Purpose:

Carrying out self-employed activities that consist of the purchase and subsequent sale of waste, including businessman who do not take physical possession of the waste.

WHO CAN APPLY FOR IT?

Entities or companies with registered office in the Community of Castilla y León, acting on their own behalf in the purchase and subsequent sale of waste, including businessman who do not take physical possession of the waste.

HOW DO I QUALIFY?

  • Having a registered office in the Autonomous Community of Castile and León.
  • To operate in Castile and León, companies or entities whose registered office is located outside of Castile and León must be registered in the Autonomous Community where their registered office is located.

What documents do I need?

  • Communication form, in the standardized format (access the "Electronic Forms: Prior Notifications and Authorization Requests" module via the link).
  • National Identity Document (DNI/NIE) of the interested party, if they have not authorized the Administration to verify their identity data.
  • National Identity Document (DNI/NIE) of the representative, if they have not authorized the Administration to verify their identity data.
  • Documentation proving legal representation, if not previously submitted.
  • Proof of payment of the fee in accordance with the Annual Order approving the publication of the rates of the fees in force must be paid. .Public entities are exempt from this fee when acting within their functions or powers.
  • Documentary evidence of the positive value of the waste.
  • Information on the mechanism for providing documentary evidence to the initial producer or other holder of the waste that the complete treatment process has been carried out.
  • When the waste businessman takes physical possession of the waste, identification of the storage facility (owner company, address, NIMA code, and authorization number).
  • In the case of hazardous waste businessman, documentation proving the financial guarantees required under Royal Decree 208/2022 of March 22, on financial guarantees for waste management:
  • Declaration of responsibility with the calculation of the bond amount, according to the template included in the "downloads" section.
  • Proof of deposit of the bond, issued by the bank or institution.
  • Certificate from the insurance company proving the formalization of the civil liability insurance, using the template included in the "downloads" section (based on Annex III of Royal Decree 208/2022 of March 22).

  • Commission Decision 2000/532/EC on the list of waste (OJ L 226, 06-09-2000).
  • Royal Decree 553/2020, of June 2, regulating the transfer of waste within the territory of the State (BOE 19-06-2020).
  • Royal Decree 208/2022, of March 22, on financial guarantees in the field of waste (BOE 01-04-2022).

ADDITIONAL INFORMATION:

Submission of the notification: The notification will allow the exercise of the activity of waste businessman from the day of its presentation, without prejudice to the powers of verification, control and inspection of the Administration of the Community of Castilla y León.

Registration in the Waste Production and Management Registry: Once the notification is accepted, it will be registered in the registry of the Regional Government of Castile and León. The Environmental Identification Number (NIMA) and the registration number can be verified at the following link: NIMA search engine .

Likewise, the information in the notification will be incorporated into the national Waste Production and Management Registry within a period not exceeding fifteen days from the registration in the regional registry.

Detailed information regarding registration in the Waste Production and Management Registry, as well as the obligations related to carrying out your activity, will be sent to the email address provided for notification purposes in the prior notification. Therefore, it is important that the email address field in the form is completed correctly.

Changes to company name, registered office address, or contact information for registered activities: See section III of the page “Waste Production and Management: Authorizations and Prior Notifications” (see section “Related Content”).

Cessation of activity: When activity ceases, you must submit a declaration of responsibility to cancel the notification in the Waste Production and Management Register (see section “Related Content”).
