Prior notification of activities of food businesses and food activities

HOW DO I QUALIFY?

• The presentation of the prior notification will be the sole and sufficient condition for the registration of the companies and establishments in the corresponding register to be processed and, simultaneously, for the activity to begin, without prejudice to the controls that may subsequently be carried out.
• The territorial scope of the register does not make any difference in terms of the guarantees of official control exercised by the Official Services, nor in terms of the full responsibility of the economic operator with regard to compliance with food legislation. →Food business operators and food establishments shall be obliged to communicate any modification of the mandatory information data necessary for their registration as well as the definitive cessation of the economic activity (article 4.3 of Decree 18/2016, of 7 July).
• The Official Public Health Services may carry out the official visits and controls necessary to verify the activities carried out by the establishment and whether or not they correspond to those that appear in the Communication, as well as to verify compliance with the applicable health regulations.

What documents do I need?

The PREVIOUS COMMUNICATION of activity must be submitted according to the standardised form, you must access the online application/form for ‘Prior notification of activity’ by filling in the obligatory and optional fields. Once the form has been completed, click on the PDF button to generate a document in this format. Once the PDF document has been generated, you can print or save a copy of the form.

The application shall be accompanied by the following documentation:

• Document accrediting the NIF of the operator, except, in the case of the DNI or NIE, authorisation to the Administration of the Community of Castilla y León to obtain directly or by telematic means the verification of the personal identity data.
• Document accrediting whoever is the legal representative of the applicant, if applicable.
• Document certifying the change of ownership, in the case of modifications due to a change of owner.
• Proof of payment of the fee corresponding to the Health Services Tax (Code 306.1).

Likewise, any modification of the data initially provided in the Prior Communication or the definitive cessation of the activity will be communicated in accordance with the aforementioned standardised form.

FEES: The fee for health services (Code 306.1 Health protection - Food companies, establishments and/or activities), set out in the Annual Order approving the publication of the rates of the fees in force must be paid. , will be charged for the processing of the initial inscriptions in the corresponding official registers or the modification of registration data that entails an administrative study of a technical nature. The fee will vary depending on whether the establishment is national in scope and must be registered in the RGSEAA or local.

The managing bodies for the processing and collection of the fee correspond to the Territorial Health Services of the province to which the Prior Notifications are addressed and the self-assessment form 046 must be used. (In the space for self-assessment, the name of the activity for which the self-assessment is being made and the amount of the same must be entered).

WHAT TIME DO I HAVE TO ASK?

Open and permanent.

DEADLINE FOR RESOLUTION:

• The presentation of the Prior Communication will be the sole and sufficient condition for processing the registration of companies and establishments in the Register of Food Companies and Activities of Castilla y León (REAAL) and, in the case of national establishments, in the General Health Register of Food Companies and Activities (RGSEAA), so that they can simultaneously start their activity, without prejudice to the controls that may subsequently be carried out.

Organ that resolves:

• General Manager of Public Health: in the case of registrations of food businesses, establishments and activities with a national identification number (Section A of the REAAL).
• Head of the Territorial Health Service of the corresponding province: in the case of registrations of food businesses, establishments and activities with a regional identification number (Section B of the REAAL). 

NOTIFICATIONS:

• Electronic notification by appearance, by means of notification via the e-mail address included in the application.
• By post at the establishment's address or at the place indicated for notification purposes.
