Request for consumer arbitration

Purpose:

To submit to arbitration any dispute between a consumer or user and a business or professional concerning the consumer's legally or contractually recognised rights.

WHO CAN APPLY FOR IT?

All those concerned.

HOW DO I QUALIFY?

Acting as a consumer or user, which are considered to be natural or legal persons acting outside the scope of a business or professional activity, and not having lodged a complaint for the same facts before another Consumer Arbitration Board, before a judicial body or before another administrative body such as the Secretary of State for Telecommunications and the Information Society (SETSI).

What documents do I need?

Fill out the application form and attach, if applicable, any document proving the relationship between the claimant and the claimant: Budget, invoices, guarantees,…

WHAT TIME DO I HAVE TO ASK?

The civil statute of limitations applies, unless the public offer to submit to the arbitration system made by the company has set an ad hoc time limit.

DEADLINE FOR RESOLUTION::

  • 90 calendar days from the date on which the arbitration procedure is agreed to begin (not from the filing of the application).

NOTIFICATIONS:

  • Electronic notification by appearance, by means of a notice via the e-mail address included in the application. This notice shall not have the effect of a notification until the interested party accesses the content of the notification in the NOTI notification system.

Appeals:

  • The decision of the chairman of the Consumer Arbitration Board on the admission or rejection of the request for arbitration in the cases provided for in article 2 of Royal Decree 231/2008, of 15 February, which regulates the Consumer Arbitration System, may be appealed before the Commission of the Consumer Arbitration Boards within 15 days of notification of the decision being challenged.
  • The decision to reject an application that is unfounded or that does not affect the rights and legitimate economic interests of consumers and users puts an end to administrative proceedings.

Steps for electronic processing (online):

    2. By means of an Online PDF Form  ( Instructions for carrying out electronic procedures ) by opening the PDF directly with Adobe Acrobat Reader or saving it, filling in the required fields and sending through  Electronic Administration Application
    3. Via Web Form: Fill in the required fields for each section, click "Review" and make the appropriate corrections, if applicable, and then click on the electronic processing option ("Submit/Send/Save")..
