Substantial modification of activity or facility with environmental authorisation

Purpose:

Request the competent department to amend the environmental authorisation as a result of a substantial modification to a facility or activity that has previously been granted environmental authorisation.

WHO CAN APPLY FOR IT?

Owners of facilities located in Castile and León who plan to substantially modify a facility with prior environmental authorisation.

What documents do I need?

Application for modification of the environmental authorisation as a result of a substantial modification of the facility or activity in accordance with the standard form available in the section ‘Electronic processing’ or ‘Download forms and annexes’, accompanied by the documentation indicated in the attached file entitled Documentation to be submitted.

Proof of payment of the fee in accordance with the  Annual Order approving the publication of the rates of the fees in force must be paid. . You can make the payment and submit the settlement electronically through the Virtual Office (OVIA) available at http://www.tributos.jcyl.es, using standard form 046.

The Data Incorporation form should only be submitted when new information or documentation is to be incorporated into a Substantial Modification Request procedure that has already been initiated.

WHAT TIME DO I HAVE TO ASK?

DEADLINE FOR RESOLUTION:

  • In accordance with Article 21 of Law 16/2002, of 1 July, the competent body for granting environmental authorisation shall issue a decision concluding the procedure within a maximum period of 6 MONTHS. If no express decision has been notified within this period, the application submitted may be deemed to have been rejected.

NOTIFICATIONS:

  • By Postal Mail at the address of the interested party.
  • Electronic notification by appearance, by means of a notice via the e-mail address included in the application. This notice shall not have the effect of a notification until the interested party accesses the content of the notification in the NOTI notification system.

  • The administrative department competent to decide on applications for environmental authorisation in accordance with the revised text of the Castile and León Environmental Prevention Act approved by Legislative Decree 1/2015 of 12 November is the head of the Regional Ministry responsible for environmental matters, by virtue of the powers conferred on him by Article 19 of the said Act. Consequently, it is incumbent upon the same head to resolve the present procedure.

Control and Monitoring

  • To submit periodic reports, use the form ‘Incorporation of data and/or documents’ and select the concept ‘2364-CONTROL AND MONITORING OF ACTIVITY. PERIODIC REPORTS’ from the drop-down menu corresponding to the procedure in point 3.

Steps for electronic processing (online):

  1. Provide an  electronic certificate and  technical requirements.
  2. Access the processing, being able to make use of three possible different means, where appropriate::
    1. Through an Application: Authenticate (electronic certificate, DNIe, Cl@veFirma, Educa account, etc.), select the procedure, fill in the required fields and follow the instructions on the screen..
    2. By means of an Online PDF Form  ( Instructions for carrying out electronic procedures ) by opening the PDF directly with Adobe Acrobat Reader or saving it, filling in the required fields and sending through  Electronic Administration Application
    3. Via Web Form: Fill in the required fields for each section, click "Review" and make the appropriate corrections, if applicable, and then click on the electronic processing option ("Submit/Send/Save")..
  3. Check the , attach documentation, sign and electronically record all documentation..
  4. Download proof of presentation.
