WHO CAN APPLY?
- It is not possible to recognise new pensions from the Social Assistance Fund for old age or illness because these pensions have now been abolished.
- Royal Decree Law 5/1992 of 21 July on Urgent Budgetary Measures abolished welfare pensions, but maintained the entitlement of those who were receiving them when the Royal Decree came into force.
WHAT ARE THE REQUIREMENTS?
These pensions have gradually disappeared, either because their recipients have opted to receive other forms of assistance, because the recipients have died, or because the right to receive them has been extinguished due to the recipient no longer meeting any of the requirements that gave rise to their recognition.
The General State Budget Law for each year establishes a periodic review to verify that the requirements that gave rise to their recognition are still being met.
In order to maintain the right to these benefits, the following requirements must be met:
- Lack of financial means for subsistence.
- For these purposes, anyone who receives income for their exclusive benefit during the calendar year that is less than the annual amount of this assistance, whether in the form of income, remuneration, pensions or any other type, is considered to lack such means.
- Those who are part of families whose annual per capita income is less than this amount are also considered to lack means.
- Not having relatives who are obliged to care for them in the manner established in the Civil Code or, if they do have relatives, those relatives lack the material means to do so.
- Not belonging to religious communities, institutes, orders or organisations which, by their rules or statutes, are obliged to provide assistance and which, given their income and the burdens on them, have the financial means to do so.
- Not be the owner or usufructuary of movable or immovable property whose characteristics, valuation and saleability clearly indicate the existence of sufficient material means to provide for subsistence.
- Have reached the age of sixty-nine, in the case of old-age assistance; or, in the case of sickness assistance, be totally incapable of performing any kind of work.
- In this case, a situation of incapacity shall be deemed to exist where, although the person is able to perform some type of work, this is not the usual type of work in their place of residence, and due to other circumstances they are unable to move to where they can perform it.
