These are pensions whose purpose is to ensure welfare coverage for those who have not contributed to Social Security or have done so for an insufficient period of time to be entitled to a contributory pension and who lack the financial resources to support themselves. There are two types of non-contributory pensions (PNC):
PNC Housing Rental Supplement:
This is a pension supplement for Social Security retirement and disability pensioners, in its non-contributory form, who can prove that they do not own a home and whose usual place of residence is a rented property.
Annual review:
Entitlement to the PNC is reviewed annually to verify that beneficiaries continue to meet the requirements for pension recognition.
WHAT TIME DO I HAVE TO ASK?
The application period for NON-CONTRIBUTORY PENSIONS is open all year round.
The HOUSING RENT SUPPLEMENT can be applied for throughout the year.
The ANNUAL DECLARATION for recipients of Non-Contributory Pensions (PNC) must be submitted before 1 April each year.

WHO CAN APPLY?
Spanish citizens and nationals of other countries, with legal residence in Spain who meet the requirements established for each type of non-contributory pension.
WHAT ARE THE REQUIREMENTS?
The requirements for obtaining a non-contributory RETIREMENT pension are:
- Be at least 65 years of age.
- Be a legal resident of the country and have been so for 10 years between the date on which the applicant turned 16 and the date of the pension application. Of those 10 years, 2 must have been consecutive and immediately prior to the date of application.
- Lack sufficient income or earnings under the established terms (see PDF file below).
The requirements for obtaining a non-contributory DISABILITY pension are:
- Be over 18 and under 65 years of age.
- Be a legal resident of Spain for at least 5 years, 2 of which must be immediately prior to the date of application for the pension.
- Have a disability or chronic illness with a degree of 65% or higher.
- Lack sufficient income or earnings under the established terms (see PDF file below).
- Persons who meet the above requirements, with a degree of disability equal to or greater than 75% and who can prove the need for a third party, will be entitled to a supplement of 50% of the amount established for the non-contributory pension in the General State Budget Law.
Requirements for the RENT SUPPLEMENT:
- Be in receipt of a non-contributory retirement or disability pension on the date of application and on the date of decision.
- Not own any property.
- Be the tenant of the property on the date of application.
- Not be married to or related to the landlord of the rented property up to the third degree, nor be in a stable relationship with the landlord with a similar emotional bond to that of a married couple.
- Have your habitual residence in the rented property.
- The lease must be valid for at least one year.
- You must have resided in the rented property for a minimum period of 180 days prior to the date of application.
- If two or more persons living in the same rented property are entitled to a non-contributory pension, only the person who is the holder of the rental contract, or if there are several, the first of them, will be entitled to this supplement.

WHAT DOCUMENTS DO I NEED?
- OFFICIAL APPLICATION FORM, which can be obtained from the Regional Social Services Office and on this website.
- DOCUMENTATION to be submitted with the PNC application:
- When the application is signed by someone other than the potential beneficiary, proof of representation must be provided:
- If the person signing the application acts as the applicant's guardian: by means of a copy of the court ruling establishing support measures for the exercise of the applicant's legal capacity.
- If the person signing the application is acting in the exercise of a legal incapacity established by the judicial authority prior to 3 September 2021: a copy of the court ruling declaring the legal incapacity of the applicant for the pension or benefit and the court ruling appointing the guardian.
- If the person signing the application has been appointed by the applicant: certificate from the Civil Registry or copy of the public deed stating that they have been voluntarily appointed by the person concerned to provide support measures for the exercise of their legal capacity.
- If the person signing the application is acting as a de facto guardian without being appointed in a public deed: a de facto guardian form, duly completed and signed by the de facto guardian.
- If the person signing the application is acting as a representative: a document certifying their representation.
- You may provide any other documents you deem appropriate to substantiate the information provided in the application, relating to residence, your own financial resources and those of the persons with whom you live, as well as proof of cohabitation.

Effect of ADMINISTRATIVE SILENCE: dismissal
APPEALS:
• Appeal prior to social jurisdiction proceedings, before the Territorial Manager of Social Services, in accordance with the provisions of Article 71 of Law 36/2011, of 10 October, regulating social jurisdiction.
• Deadline for filing the claim: thirty days from notification of the initial decision, if it is express, or from the date on which, in accordance with the regulations governing the procedure in question, administrative silence is deemed to have occurred.
• Deadline for resolution: forty-five working days. If this period elapses without an express decision, the claim shall be deemed to have been rejected due to administrative silence.
Notificaciones:
- By Postal Mail at the address of the interested party.
- Electronic notification by appearance, by means of a notice via the e-mail address included in the application. This notice shall not have the effect of a notification until the interested party accesses the content of the notification in the
NOTI
notification system.
ADDITIONAL INFORMATION:
Obligations of PNC beneficiaries
- Notify the department that manages your pension within 30 days of any changes in your cohabitation status, marital status, residence, personal and/or family financial resources, and any other changes that may affect your entitlement to or the amount of your pension. If they fail to notify these changes within the specified period and these changes result in a modification of the amount of the pension or its termination, they will be obliged to return any amounts unduly received.
- Non-contributory pensioners must submit an annual declaration of their income and that of their household, using the form sent to them by the departmentthat manages their pension. This annual declaration must be submitted in the first quarter of each year (before 1 April each year). Based on the information declared by pensioners and that available to the Administration, the amounts received in the previous year are adjusted and the amount of the pension to be received in the current year is established, if the review results in a change to the amount initially updated. Pensioners are obliged to repay any amounts that have been unduly received.
Incompatibilities
Non-contributory retirement and disability pensions are incompatible:
- With each other.
- With welfare pensions from the Social Welfare Fund (FAS).
- With the Minimum Income Guarantee and Third-Party Assistance Subsidies under the General Law on the Rights of Persons with Disabilities and their Social Inclusion.
- With the status of beneficiary of the financial benefit for a dependent child with a disability.
Compatibility of PNC DISABILITY with self-employment or employment by others
- Persons who, prior to starting work, were receiving a non-contributory disability pension may combine the pension with income from work for the four years following the start of work.
- This cannot be combined and the right to the pension will be suspended when the income derived from the work activity is, in 2025, equal to or greater than 15,105.80 euros.
- If the sum of the annual amount of the pension recognised for the pensioner and the annual income received or expected to be received from the work activity exceeds the limit of €15,105.80, the annual amount of the pension will be reduced by the amount necessary to ensure that it does not exceed this limit.
- The indicated limit of €15,105.80 is the result of adding the annual amounts in force in 2025 for the public multiple-effect income indicator (IPREM), which is €7,200.00, and for the non-contributory disability pension, which is €7,905.80.
- If, after the four-year period has elapsed, the pensioner continues to work, their right to a pension will be suspended and will remain so until they cease working.
- Once the pensioner ceases working, their right to a pension will be restored, without taking into account the income derived from that activity.

Termination of entitlement to the PNC
- Entitlement to the non-contributory pension will terminate in any of the following circumstances:
- Loss of legal resident status or transfer of residence outside Spanish territory for more than ninety days during the calendar year.
- Having sufficient income or earnings, i.e. exceeding the limits on accumulated resources set for each case.
- Improvement in the disability or chronic illness suffered, resulting in a degree of less than 65% (only PNC for disability).
- Death of the beneficiary.
Waiver of the PNC
- Non-contributory pensions cannot be waived.
- Notwithstanding the above, it is possible to waive a non-contributory pension in the case of a minimum amount in order to access the dependent spouse supplement, provided that this is more advantageous financially for the family unit.
