Commercial licence for large commercial establishments

Purpose:
Apply for a licence for establishments that are considered large commercial establishments (establishments with a retail sales area equal to or greater than 2,500 m2).
WHO CAN APPLY FOR IT?
- Large individual commercial establishments: Owner of the commercial activity.
- Large commercial establishments of a collective nature: Promoter of the large establishment.

What documents do I need?
Application on a standard form, accompanied by the documentation indicated in article 19 of Legislative Decree 2/2014:
- Deed of incorporation and NIF of the applicant (legal entity).
- NIF of the applicant (in the case of a natural person).
- DNI/NIE of the representative.
- Documentation accrediting the legal representation held or responsible declaration of the same.
- Documentation accrediting the availability of the land or building on which the establishment is to be set up, which is authorised by means of the business licence or a declaration of responsibility for the same.
- Project of the establishment:
Report and plans (definition of, at least, a technical preliminary project) showing the total built surface area, retail surface area, as well as the surface area for the different uses.
Plans, with the areas indicated in the previous section, of the last execution project for which the building permit was obtained (in cases of modification of the sales area).
Number of public parking spaces.
Map of geographical location in the municipality.
- Urban planning instrument:
Town planning certification.
Copy of the enabling urban planning instrument at the most advanced stage of approval in which it is found, which will be at least that of its provisional approval.
Indication of the file, database or documentary collection in the case of definitive approval of the urban planning instrument.
If applicable, the corresponding environmental processing.
- Report referring to the criteria established in art 22 of D.L. 2/2014, of 28 August.
- Document accrediting payment of the fee for the processing of commercial licences for large commercial establishments, in accordance with the provisions of the
Annual Order approving the publication of the rates of the fees in force must be paid.
In the event that the documentation to be submitted electronically is larger than the size admitted at the headquarters (8 Mb per file and a maximum of 30 files), it may be submitted on any physical medium and sent to the Directorate General for Trade and Consumer Affairs, stating this circumstance in the standard application form in the section corresponding to ‘Documentation sent on a physical medium’.
WHAT TIME DO I HAVE TO ASK?
Open and permanent.
DEADLINE FOR RESOLUTION:
- 3 months from the day on which all the necessary documentation has been received.
NOTIFICATIONS:
- Electronic notification by appearance, by means of a notice via the e-mail address included in the application. This notice shall not have the effect of a notification until the interested party accesses the content of the notification in the
NOTI
notification system.
