Authorization of waste treatment operations

HOW DO I QUALIFY?

• Applicants must have their tax domicile or registered office in Castile and León and be engaged in the operation of waste collection and treatment facilities within Spanish territory.
• To carry out waste treatment operations in fixed or mobile facilities, in addition to this authorization, the facility must have the authorization regulated in Article 33.1 (fixed facilities) or 33.5 (mobile facilities) of Law 7/2022, of April 8 (see sections Additional Information, Related Information).
• If the authorization for said facility includes a financial guarantee, the natural or legal person carrying out the treatment operations must provide proof of the establishment of said financial guarantees to the competent authority of the autonomous community where the facility is located.
• If waste treatment operations are to be carried out without an associated facility, it will be necessary, in addition to this authorization, to submit the prior notification regulated in Article 33.4. of the aforementioned law (see sections Additional Information, Related Information).

What documents do I need?

• Application, according to the standardized form (application form and instructions in the "Electronic Processing" section of this page).
• The application must be accompanied by the following DOCUMENTATION, and proof of payment of the corresponding fee, in accordance with the Annual Order approving the publication of the rates of the fees in force must be paid.   (payment instructions are detailed in the "Fee Information" section).

WHAT TIME DO I HAVE TO ASK?

NOTIFICATIONS:

• Electronic notification by appearance, by means of a notice via the e-mail address included in the application. This notice shall not have the effect of a notification until the interested party accesses the content of the notification in the NOTI notification system.

ADDITIONAL INFORMATION:

The authorization granted to the interested party will be valid throughout the national territory and constitutes recognition of their status as an authorized waste management operator for carrying out waste treatment operations. They may operate as an operator in authorized waste collection and treatment facilities, whether they own the facility or a third party owns it.

To carry out treatment operations in a fixed installation, the facility must have the corresponding authorization, in accordance with Article 33.1 of Law 7/2022, of April 8, granted by the autonomous community where the facility is located.

To carry out treatment operations in a mobile installation, as established in Article 33.5 of Law 7/2022, of April 8:

• the facility must have the administrative authorization granted by the autonomous community where the owner of the facility has its registered office.
• the operator of the facility must also submit the corresponding prior notifications of mobile plant to the autonomous communities where the treatment is carried out.

If you carry out waste treatment operations without associated installations (e.g., applying sewage sludge to the land), you must submit the corresponding prior notifications to the Autonomous Communities where you carry out these operations, as determined by Article 33.4 of Law 7/2022, of April 8.

As a natural or legal person authorized to carry out hazardous waste treatment operations, you must comply with the bond and financial guarantee requirements established in the individual authorizations for the treatment installations you operate. Specifically, to operate treatment installations located in Castile and León, you must first demonstrate to the Directorate General of Infrastructure and Environmental Sustainability that you have signed the financial guarantees for waste management that may be established in the authorizations for said installations.

When a change of operator occurs at a installation (becoming the operator or ceasing operations), the facility owner must notify the regional government where the installation is located of this change so that the Waste Production and Management Register can be updated (see “Notification from the Installation Owner or Operator” in “Related Content”).

When a natural or legal person ceases their activity carrying out waste treatment operations, they must submit a declaration of responsibility to cancel their authorization in the Waste Production and Management Register (see “Declaration of Cessation of Waste Production or Management Activity” in “Related Content”).
